“The CAC’s acceptance of the City Screen Staff Forum as a trade union sets a dangerous and damaging precedent for industrial organising. The challenge failed as the Central Arbitration Committee (CAC) decided that while ‘highly atypical as an organisation, let alone an organisation of workers’, the Forum met the basic legal definition of a trade union. Over this period there are four separate instances of staff members on the Forum Executive Committee leaving due to dismissal by Picturehouse, resulting from, action over union-related activity or minor incidents (since the Cineworld takeover Picturehouse allow cinema management to respond to minor, first-offence breaches of rules – for instance an incident when a single popcorn or tea staff-perk has been issued over the quota allowed – with weeks of suspension from work, frequently ending with dismissal for ‘gross misconduct’, without any opportunity to improve conduct or Final Written Warning.
